In other words, pay for membership to accsess more audio tracks to hear?

A: Hello Sumo-ling,

The license we provide allows you to use the audio in any type of synchronized production. It does not include licensing for the audio to be used for un synchronized use like reselling or offering it on other websites. Sorry to let you know.

Probably you get me wrong: the tracks will not be available for download, not for reselling. Just as a background music to listen.

In the previous "Jamendo deal", it was possible - we can use the Jamendo's tracks as background music for a website. In this case, they use the term "synchronizing" the track to a website.

Please, confirm that your license is limited to video synchronization only, and it's not possible to use your tracks in a web-based application (websites), or in any other applications like smartphone apps.

Sorry I guess our team misinterpreted your question. Audio Hero is licensed for synchronized use on a web based application (websites). Also can be used for many other uses like television, radio, film, multimedia and audio-visual presentations, and games etc.

The question is:
Can your audio tracks be used in a membership section of websites like these ones: mynoise.net, hipstersound.com

In other words, can we ask a client to pay for a membership to listen to more audio tracks (examples of the web-based ambient noise generators: mynoise.net, hipstersound.com).

In other words, use as a background sound for a website but available only in the paid (premium) section?

We thought before you were just asking if you can place synchronized music on a web-based application (websites).

If you are placing our music on a membership site like mynoise.net or hipstersound.com and looking to offer it as apart of a premium membership that you are selling for listening purposes, it would still be considered unsynchronized. Unless you have some type of video or visual effect playing while the music is being played. Will any video or visual effects be played?

OK, Graig, it's more clear now: placing your music on a paid membership site for listening purposes (without video, visual effects, game) is considered unsynchronized. That's all clear.

But what about the case when we put your sounds for listening purposes only (as background sounds) on a free and publicly accessible webpage, like this:

Sorry I am not familiar with these two websites defonic.com and hipstersound.com. What is the main purpose of offering these free sounds for listening on these two sites? Mediation? Sleeping?

I see that defonic.com offers advertising which would make it unsynchronized as it is offering the music for free but making money from the advertising. The Hipstersound.com could be synchronized if it was free and there is no advertising. Also it has some type of visual effect.

So we can use it for listening on web pages with no advertising, for free. Am I right?

The sounds can be offered for listening purposes if it is synchronized to some type of visual and there is no financial gain from offering the sounds.
