your 2 question fit well together. You are allowed to have all the agents on the same level, so no mixing. Since it's complex system, your portal needs to be set to have the particular features ready and your agents use these functions.
So it's not possible to mix subscription, however if you don't use any of the premium features, you can simply downgrade all your portal to lower tier and add seats for smaller monthly fee.

If I downgrade as suggested -
1. would I still have the two free agents on this deal...and only have to pay for the 3+ agent?
2. would I be able to upgrade back to the original plan (including retaining the two free agents on this deal)?
PS: Is LA considering allowing mixed subscription? IMHO the lack of this feature is (very) likely hurting your conversions (read sales)...not for this deal, but for your day-to-day business.
