Q: Do overlays actually work?

I'm interested in using this for auditing our websites to make the website accessible.

If you google "Accessibe Overlay Lawsuit", you'll see things like this

"Studies and legal experts note that over 800 businesses using overlay widgets have been sued in recent years. The widgets inject JavaScript to mask issues instead of fixing the underlying code"

What's your take on these? Is there a way to use the tool to do testing without having to use the overlay?

I'd love to make the site truly accessible through audits, and updates instead of a widget, and want to see if this tool can help. It seems very overlay widget focused so a bit worried about investing in an overlay tool, but very interested interested in finding an auditing tool.
