I have API access and I am on tier 2... is that because I bought mine last year in November and you had fewer and different tiers then?

Yep, exactly :)
Your Tier 2 is from the previous AppSumo launch, when the tier structure and limits were a bit different. We grandfathered all of those accounts in, so you keep the API access and the benefits that came with your original purchase.
