Q: GDPR Compliance for Italian clients using US-based builders (Webstarts)
I build and sell websites for Italian clients using Webstarts (a US-based web builder). Since the data is hosted on US servers, I have a few specific questions:
1. Does your generated Privacy Policy include the necessary clauses for EU-to-US data transfers (Standard Contractual Clauses or Data Privacy Framework references) specifically for platforms like Webstarts?
2. Are the policies fully translated into Italian, and is the legal terminology accurate for the Italian GDPR implementation?
3. Does your solution include a Cookie Banner that supports 'prior blocking' (as required by the Italian Garante) and does it provide a log of user consents for audit purposes?
4. Can I use GetTerms to generate a DPA (Data Processing Agreement) between me (the agency) and my final clients?

1. yes it does include a clause for data transfers
2. Yes and yes
3. Yes, of course! By default, we auto-block all cookies until consent is granted for the EU. Your consent logs are all stored and accessible, with no storage limits.
4. We don't currently have a DPA generator, but we're making big improvements to our policy generator infrastructure, which should allow us to deliver this policy and more in the coming months.
