Q: ToS questions about the LTD. Can you clarify AI training, termination, and inactivity deletion?
Hi Brian, very interested in the product but have some ToS concerns holding me back from using.
AI Training: Sec 5.2 says you use our 'Content' to 'improve' your service. Many of us cannot let our client data be used for training or woud like to keep our strategy and process confidential. Would you offer a tier that guarantees AI training is disabled?
LTD vs. Termination: Sec 16.4 lets you terminate accounts 'for any or no reason.' This makes the lifetime promise feel risky. Can you confirm you'll waive this 'termination for convenience' clause for all AppSumo users?
Inactivity: Sec 16.7 allows deleting data after 6 months of inactivity. Many of us have long breaks between projects. Can you confirm this only applies to free accounts, not paid LTDs, or extend it to 24+ months?

AI training (Sec. 5.2): We do not use your content to train any AI models, and none of our features train on customer content. The “Content” language in Sec. 5.2 exists to let us improve product safeguards (e.g., validation, safety filters, and limits on what can be input into Puzzle), not to repurpose your data for model training. To remove any doubt, we’ve updated our ToS to explicitly state: customer content is not used for AI training.
LTD vs. Termination: Sec 16.4: This type of broad termination language is standard in SaaS terms and helps vendors address edge cases; you’ll see similar clauses "at any time, for any reason" from providers like Lucidchart (Lucid), and Miro. You can reference their TOS to evaluate our terms versus other best-in-class software companies.
Inactivity: Sec 16.7: We'll extend the inactivity window for deleting data to 24 months for all users. We’ve updated our ToS to reflect this.

Hey Triangleforces, I get why that wording stands out. It’s a standard SaaS clause that gives providers flexibility to act in rare edge cases (fraud, security issues, legal obligations, platform abuse). In practice, our focus is on keeping legitimate customer accounts active and supported, and we use suspension/termination only when necessary to protect users and comply with the law.

Thanks for your clear and transparent reply. Updating the ToS to explicitly state that customer content isn't used for AI training is a green light for me. Extending the inactivity window to 24 months resolves my other concern completely. I appreciate you not just saying it but being responsive and putting it in writing.

Termination - I understand your reasoning. You need to protect the platform from abuse. TBH, it's still a risk. Many of us have been burned by other LTDs that canceled services (like Ranktracker), and AppSumo offered no protection. This is really a problem AppSumo should solve with a TOS for their partners. That said, I'm willing to take that risk based on your professional responses. Thanks.
